Motor Vehicle Accidents

Injured In A Motor Vehicle Accident?
A car accident can be a horrific experience. It may be especially difficult to overcome physical injuries, emotional trauma and financial challenges when a crash is the result of another driver’s negligence. It’s natural to feel angry and want to hold the other person responsible. Personal injury law can allow you to do that.

The recovery process following a traffic crash is a long journey, but it’s not one that you have to take alone. Obtaining the help of an experienced lawyer can give you the best opportunity to get justice. You’ll have someone on your side who knows the ins and outs of personal injury law, someone who can fight for what you deserve.

Texas state law outlines specific actions accident victims must take in order to pursue compensation from an at-fault driver. That process can be frustrating and confusing without experienced legal help.

Common Types Of Traffic Accidents
Texas driving laws include a standard of “proper lookout,” which requires motorists to remain aware of their surroundings while behind the wheel. This also means that every licensed driver is expected to operate his or her vehicle in a way that is reasonable and will not harm another person or destroy property.

When a person fails to exercise reasonable care while driving, he or she is at risk of being held responsible for the dangerous behavior. An attorney can be helpful in determining whether negligence played a part in these types of crashes:

  • Car accidents, such as collisions resulting from speeding and reckless driving
  • Motorcycle accidents, including accidents in which motorcyclists are struck by larger vehicles
  • Truck accidents that involve semis and other commercial vehicles
  • Pedestrian accidents, including situations in which an inattentive driver strikes someone walking in a crosswalk
  • Bicycle accidents, such as when a car hits a cyclist in a designated bike lane

Get Legal Help After An Accident
An experienced attorney is seasoned in compiling evidence that can be used to show another motorist negligent. Police reports, for example, may be helpful if they indicate that the other person was responsible for an accident. Eyewitness accounts may also serve as evidence against an at-fault driver. Additionally, a lawyer may obtain phone records to determine whether texting played a role in an accident.

An attorney can also help to establish that you have suffered damages as a result of the motor vehicle accident. You may be asked to provide documentation of medical bills, vehicle repair costs, lost wages and other losses associated with a crash.

Personal injury law can be complex, and the process of proving a case can take considerable time, effort and resources. An attorney has knowledge and tools that will take the pressure off of you so you can focus on recovering from a car accident.

Police say 5-car crash started with speeding wrong-way driver

A Texas car accident involving five vehicles left one person dead and three injured. The crash was caused by a van that was speeding and going the wrong way on Trinity Boulevard in Fort Worth. The accident started when the maroon van hit a white Chevy Malibu. The Chevy was sent into the median, and the van then hit a black Suburban. The Suburban was then rear-ended by a Volkswagen, and as the van was rolling, it was hit by a fifth vehicle.

A woman who was a passenger in the Suburban was pinned inside the vehicle and died. Three other people involved in the crash were injured and were taken to hospitals. One was transported by helicopter and the others by ambulance. Fire officials said that the accident left several people trapped in their cars, and they had to be extricated.

Police did not believe that drugs or alcohol were involved in the fatal car accident. A man who lives in the area where the crash happened said that many drivers there disregard the 40-mph speed limit.

When someone is killed in an accident, their loved ones may be entitled to compensation if it can be proven that another party’s negligence was a contributing factor. Through a wrongful death lawsuit, the family of the woman who was killed in the accident might receive funds that cover a number of damages, including lost financial support and final expenses. A persona injury lawyer who is familiar with fatal car accident cases could help the woman’s family develop a case that demonstrates the at-fault driver’s negligence and liability.

1 killed after 5-vehicle crash on Texas highway

Sources indicate that an 18-wheel FedEx truck was rear-ended by another car. The impact forced the truck to flip over, which caused a chain reaction that ultimately came to involve three other vehicles. One person died as a result of the incident, but the report does not specify whether anyone else was injured.

In a situation like this, investigators will often work to determine the causes and circumstances that led to the crash in order to ascertain the liability of one or more of the parties involved. For example, if some form of impairment contributed to the actions of the driver that rear-ended the FedEx truck, it may possible for him or her to be held accountable for the victim’s death and any other injuries or damages that occurred due to the wreck.

Someone who has been injured in a car accident might incur overwhelming medical expenses as a result of their hospitalization and ongoing rehabilitative care. In addition, some people are unable to continue working during the course of their treatment, and in some cases, the victim is never able to return to work at all. By filing a personal injury claim against the liable party, the victim could receive compensation to recover the costs of these damages. An attorney representing the victim may prove driver negligence using the evidence collected from a police investigation.

Get Justice After An Accident

Because of the long distances between cities in Texas, residents spend a lot of time on the road. If you’ve spent any amount of time driving the state’s streets and highways, you know that this high volume of traffic produces many motor vehicle accidents. Unfortunately, these crashes often have serious consequences for those involved.

The Texas Department of Transportation reports that there were more than 3,000 vehicle-related deaths in 2011, or 1.28 deaths per 100 million miles traveled. Additionally, nearly 80,000 people sustained serious injuries in vehicle collisions.

If you or a family member can be counted among those harmed in an accident, you understand the pain, suffering and financial burdens that can result from a crash. While you cannot undo what’s happened, personal injury law may allow you to sue a responsible party for damages that have been sustained.

Understanding The Costs Of Car Accidents
After an accident, your first priority must be to address any health concerns. It is not long, however, before the financial impact of a crash also comes into focus. That’s because the monetary costs associated with an accident can add up fast.

Post-accident expenses you might face include:

  • Medical bills. Hospitalization and rehabilitation costs can escalate at a rapid rate, especially when serious conditions like traumatic brain injuries or spinal fractures are involved.
  • Vehicle repair or replacement. Fixing your car, or buying another one if your vehicle was totaled, will likely be an important (and expensive) priority after a crash.
  • Lost wages. If you are unable to work following an accident, you and your family may be severely hurt financially.
  • Funeral costs. In the most tragic incidences, the death of a loved can require paying for funeral expenses.

It’s important to remember that many of the damages associated with a car or truck accident could be long-term costs for you and your family. For example, serious injuries may require extensive physical therapy or other ongoing rehabilitation. Emotional trauma related to an accident could develop into post-traumatic stress disorder (PTSD), depression or other long-term conditions, potentially requiring expensive medical treatments.

Safeguard Your Family’s Financial Future
In the event you or a family member suffer injuries in a car accident, your household is likely to go through a difficult, uncertain period. Adding to life-or-death medical concerns may be questions about how much care will cost, what expenses an insurance company will cover and whether a family provider will have to miss work for a significant period of time.

An experienced lawyer can help obtain fair compensation for injuries and property claims, negotiating with insurance companies to ensure you are treated fairly. If there is a need to go to court, an attorney can represent you. At each step of the personal injury process, a legal advocate will provide you with guidance and protect your rights.
